Litigation:
- A former state employee challenged the exclusion in Krei v. Nebraska, No. 4:19-cv-03068 (Mar. 16, 2020). Judge Brian C. Buescher dismissed her claims, but the reasoning in the opinion would not bar future state employees from successfully bringing a challenge.
- The State of Nebraska was a plaintiff in the case that challenged the implementation of the nondiscrimination regulations of Section 1557 of the Affordable Care Act, Franciscan Alliance v. Azar.
- The State of Nebraska also lead the effort to file an Amicus Brief in Support of Petitioner in R.G. Harris Funeral Homes, Inc. v Equal Opportunity Commission, in the U.S. Supreme Court.
